Initiative text

La demande d'initiative a la teneur suivante:

« La disposition ci-après, insérée comme article 58^bis, est introduite dans la Constitution fédérale :

La justice militaire est supprimée. Les délits visés par le code pénal militaire seront déférés, pour l'instruction et le jugement, à la justice ordinaire du canton dans lequel ils ont été commis.

La procédure à suivre est fixée par le code de procédure en vigueur dans le canton.

Le jugement rendu en dernier ressort par le tribunal du canton peut être déféré au Tribunal fédéral par un pourvoi en cassation.

Les arrêts infligés comme peine disciplinaire ou d'ordre ne peuvent excéder dix jours. La peine ne peut être aggravée ni par une réduction de l'alimentation ni par le retrait de la lumière du jour.

Le droit de porter plainte contre une peine disciplinaire est garanti ; l'exercice de ce droit ne peut entraîner aucune punition. »
